The Biden administration is asking the Supreme Court to halt the trademark “Trump too small” in a legal battle over political speech and First Amendment rights where a federal law bans the use of an official’s name without their permission for trademarks.
Just so it’s clear, this case is not about whether someone can put “Trump too small” on a T-shirt. They absolutely can.
The question is whether someone can trademark the phrase and thus prohibit everyone else from putting “Trump too small” on different T-shirts. The DoJ argues they can’t trademark it, which means that everyone else can also put the phrase on a T-shirt or other products (unlike, say, “Super Bowl”).
The DoJ isn’t doing Trump any favors.
“Trump too small” is a bad slogan and anyone who puts that on a shirt could probably think of something better
